Terms and Conditions

1. Overview
These Terms and Conditions (“Terms”) govern the bespoke garment service provided by Wyn-Wiley Couture (“we”, “us”, “our”) to you, the client (“you”). By paying the deposit or otherwise confirming your order, you agree to be bound by these Terms.
2. Service Process
Stage 1: Initial Consultation

A free consultation is offered to discuss your design vision, budget, and timeline.

This consultation may take place in person or by phone.

We will explain the process, pricing structure, and what we require from you.
Stage 2: Design and Quotation
-
Following the consultation, we will create a basic design and provide an estimated quote (a price range).

Final price will depend on your choice of fabric and design details.

The quote is an estimate and not a final contract price.
Stage 3: Deposit and Design Development
-
To proceed, a non-refundable deposit of £100 is required.

Terms and Conditions must be signed at this stage.

Upon receipt of deposit, we will refine the design, source fabric samples, and present them for your approval.
Stage 4: Final Price and Payment

Once the design and fabric are approved, we will confirm the final price.

The final price will normally fall within the initial quote range unless a premium fabric is selected. This will be communicated clearly when presenting fabric samples.

The outstanding balance (final price minus £100 deposit) must be paid in full before garment production continues.
Stage 5: Fittings and Toiles

We will take your body measurements and create up to three toiles (prototype garments) for fittings.

Any additional toiles requested by you beyond the included three will incur an extra charge.

If we decided a further toile is needed, this cost will be covered by us.

Fittings will be conducted at our premises unless otherwise arranged (see Section 8).
Stage 6: Final Garment Completion

Once we are satisfied with the fit, we will construct the final garment in the approved fabric.

You will have a final fitting where we will confirm fit and demonstrate how to wear the garment.

The garment will then be released to you.
3. Payment Terms
-
Payments must be made by bank transfer, cash, or other agreed methods.

The deposit is non-refundable under any circumstances, including if you cancel or change your mind.

The balance must be paid in full before the final garment is produced. Non-payment may result in delay or cancellation of the order.
4. Cancellations and Refunds
-
If you cancel after paying the deposit, no refund will be issued.

If you cancel after fabric has been purchased or work commenced on the garment, you will be liable for costs incurred up to that point.

Due to the custom nature of the product, no refunds or exchanges are offered once the final garment is completed and approved.

If you find issue or fault with the garment, we will work with you to fix/repair the issue/fault.
5. Client Responsibilities

You are responsible for attending scheduled fittings or notifying us at least 48 hours in advance if rescheduling is required.

You must provide accurate measurements if measurements are provided by a third party. We are not liable for fit issues arising from inaccurate third-party measurements.
6. Design Changes
-
Minor design adjustments may be accommodated during the toile stages.
-
Significant design changes after fabric is purchased or production has started may incur additional charges and extend timelines.

We reserve the right to refuse unreasonable or impractical changes after Stage 4.
7. Garment Care and Warranty
-
We will provide care instructions for your garment.

We are not liable for damage due to improper care, cleaning, or alterations by third parties after delivery.

Small adjustments (e.g., hemming) requested after delivery may incur additional charges.
8. Mobile Service
-
Mobile fittings and measurement appointments are available for an additional fee starting at £6.50 per return journey, depending on location.

Mobile service fees must be paid in advance or alongside other payments. This will be made clear before mobile appointment.

Current areas mobile service is offered: Fife, Edinburgh, Livingston
9. Timelines and Delays
-
We will agree a final completion date. The garment will be completed by or for this agreed date.
-
However, under extreme circumstances due to factors out of our control (illness, supplier issues etc.), delays may happen.
-
We will notify you of any expected delays as soon as possible and do our absolute best to reduced delayed times. This will be clearly communicated during the time.
10. Limitation of Liability
-
We are not liable for loss or damage beyond the value of the garment itself.
-
We are not liable for any consequential, indirect, or incidental damages.
11. Bridal and Wedding Garments
-
Due to the nature of bridal and wedding garments, we recommend ordering no less than 6 months before the event date to ensure sufficient time for fittings and adjustments. Orders with shorter timelines may be subject to a rush fee.

A minimum of three fittings is included; additional fittings requested by the client will incur an extra charge.

We are not responsible for fit issues arising from weight fluctuation or body changes after the final fitting.

It is your responsibility to store and transport the garment safely after collection. We advise hanging and transporting the garment in a garment bag (this will be supplied by us).

No refunds or exchanges are available for bridal or wedding garments once the final fitting is completed and the garment is collected or delivered.
-
Any emergency alterations required after the garment is collected may be subject to availability and may incur additional charges.

We do not guarantee compatibility with other garments, accessories, or undergarments not supplied or approved by us. Please discuss these during fittings.

A delivery service is offered by us for bridal or wedding garments. This does incur a delivery free starting from £20. An accurate free can be given once a delivery address is advised.
12. Uncollected Garments

Once the final garment is completed and the client has been notified (by phone, email, or written message) that the garment is ready for collection, the client must collect the garment within 30 calendar days of this notification.

If the garment is not collected within 30 days and no alternative arrangements have been agreed in writing, we reserve the right to charge a storage fee of £5 per week starting from day 31.

If the garment remains uncollected for 90 days from the date of notification, and no communication has been received from the client, we reserve the right to dispose of, repurpose, or sell the garment without further liability or obligation to the client.

Any outstanding balance, storage fees, or additional costs will remain payable and may be pursued through legal or debt recovery means if necessary.
13. Photography and Social Media

We reserve the right to photograph and/or video the garment and the making process (including design sketches, fabric selection, fittings, and final garment) for use in our portfolio, marketing materials, website, and social media platforms.

We will not disclose your full name or personal details without your permission.

If the garment is intended for a wedding or bridal event, we will not post or publish any images or videos featuring the garment until after the wedding date to maintain confidentiality, unless you give written consent for earlier publication.

If you do not wish for any images or videos of your garment (including images without you wearing it) to be used publicly, you must inform us in writing prior to the final garment completion.

If you do not wish for your personal image or likeness (photos of you wearing the garment) to be used, but consent to photos of the garment itself, you must also inform us in writing prior to the final garment completion.
